Supreme Court: ‘Strong on Law’
Fie on Gov. Deukmejian for saying, “I don’t believe the judiciary should be independent from the people. They are public servants just as the governor is or legislators are.” He must know “the people” can become a mob, that they often act from zeal or anger, self-righteousness or prejudice.
The function of the court is to test action by measuring it against the principles of the Constitution, the Bill of Rights and the other amendments. The court serves the public best when it protects the people from themselves by requiring them to act constitutionally.
