NEWARK, N.J. — A federal appeals court ruled Friday that former boxer Rubin (Hurricane) Carter be allowed to remain free while he awaits his third trial for a murder in a Paterson, N.J., tavern almost 20 years ago.
The three-judge panel of the Third Circuit Court of Appeals in Philadelphia also denied a prosecution request for a court-orderedpsychiatric examination.
Carter, a contender for the middleweight boxing championship when he was convicted, has spent most of the past 20 years in prison since his conviction in the shooting in 1966.
Late last year, U.S. District Judge H. Lee Sarokin overturned Carter’s second conviction and ordered him released from prison.
