Court Says Asbestos Victims Can Sue Even if Illness Is Delayed

SPRINGFIELD, Ill. — The Illinois Supreme Court ruled Thursday that victims of asbestos-related disease may sue even if their illness is not discovered for decades after exposure to the toxic mineral.
The date when the illness is discovered is the key factor in interpreting limits on how much time may elapse between the injury and the filing of a lawsuit against the manufacturer, the court said.
The ruling approved further action in a lawsuit filed by the estate of a man who died in 1982 of an asbestos-related cancer. The lawsuit contends the illness was a result of his exposure to asbestos at a shipyard during World War II.
