Amos and Andy to Stay Retired

WHITE PLAINS, N.Y. — Amos and Andy apparently won’t be moving to Broadway following a federal judge’s ruling today that CBS has not abandoned its trademark on the characters.
U.S. District Judge Gerard Goettel, ruling in a case pressed by Stephen Silverman, who planned to produce a show based on the characters, said decisions by CBS not to revive the “Amos ‘n’ Andy” series were influenced by racial sensitivity and should not result in the company’s loss of trademark rights. Therefore, Goettel wrote, Silverman is not entitled to free use of the property or characters.
