Menendez Appeal Headed for High Court

Saying they were “shocked” by a state appeals court’s decision to disclose facts that were under seal and still being challenged, defense attorneys for Lyle and Erik Menendez said Tuesday they will ask the California Supreme Court to review the matter.
The brothers are accused of murdering their multimillionaire Beverly Hills parents.
The 2nd District Court of Appeal ruled last week that audiotapes made by a psychologist who claims the brothers confessed to the crimes during psychotherapy sessions with him are not confidential and must be turned over to prosecutors.
If the decision is upheld, lawyer Leslie Abramson, who represents Erik Menendez, said she will argue that statements “by someone musing to himself on a tape recording are not admissible” as evidence.
