The city Tuesday chose not to drop its lawsuit against Pastor Wiley Drake and his church for housing homeless people in violation of city codes. A judge and city officials determined that the First Baptist Church has not met all the required city and fire codes for its temporary shelter.
But the city has agreed to drop the lawsuit, filed in 1997, if the church receives a certificate of occupancy for the shelter by Jan. 19. The church must have the city and fire authority officials sign off on the building’s safety requirements.
