Stater’s Garrett appealed a ruling to cede control.

A group led by Bernard R. Garrett, chairman of the Stater Bros. grocery store chain, filed an appeal with the Delaware Supreme Court challenging a Delaware Chancery Court ruling that gave ousted President Jack H. Brown control of the Colton company. The lower court judge ruled last week that the Brown group had won an April election placing three directors on the company’s board. The appeal doesn’t stall the change of control, which is expected to occur following a board meeting today.
